Xbox live modded xbox?

i have modded xbox 360. ive heard that if you play copied games that are safe for live there is a small chance of detection. ive played some copied games but i dont know if they are safe for live. i want to know if microsoft can detect me and ban me that ive played copied games in the past, even thought i would play only original games on live.
